PLEASE READ CAREFULLY. THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND A WAIVER OF YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION. BY ENTERING THE PREMISES, PLACING AN ORDER, OR CONSUMING ANY FOOD OR BEVERAGE AT TEAMWORKON3 BISTRO, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Guest," "you," or "your") and TeamworkOn3 Bistro, located at 2021 Lexington Ave, New York, NY (the "Restaurant," "we," "us," or "our"). By visiting the Restaurant, placing an order (in person, by phone, online, or through any third-party platform), or consuming any food or beverage prepared or served by us, you agree to be bound by these Terms. If you do not agree, you must not enter the premises or place an order.
Our food is prepared in a kitchen that handles a wide range of ingredients, including but not limited to milk, eggs, wheat, gluten, soy, peanuts, tree nuts, fish, shellfish, sesame, and other potential allergens. Cross-contact is possible and we cannot guarantee that any item is free from any specific allergen.
You are solely responsible for informing your server of any allergies, intolerances, sensitivities, or dietary restrictions before ordering. Any information we provide regarding ingredients is offered as a courtesy only and is not a guarantee.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU ASSUME ALL RISK ASSOCIATED WITH FOOD ALLERGIES, INTOLERANCES, OR ADVERSE REACTIONS, AND YOU AGREE THAT THE RESTAURANT IS NOT LIABLE FOR ANY ALLERGIC REACTION, ILLNESS, INJURY, OR HARM RESULTING FROM THE CONSUMPTION OF FOOD OR BEVERAGES SERVED HERE. In accordance with FDA guidance, consuming raw or undercooked meats, poultry, seafood, shellfish, or eggs may increase your risk of foodborne illness.
Alcoholic beverages are served only to guests of legal drinking age (21+) with valid government-issued identification. We reserve the right to refuse service to anyone at any time, for any lawful reason, including suspected intoxication. You assume full responsibility for your decision to consume alcohol and for your conduct while and after doing so. We are not responsible for any injury, damage, or loss resulting from your consumption of alcohol on or off the premises.
You voluntarily enter and remain on the premises of the Restaurant at your own risk. To the maximum extent permitted by applicable law, the Restaurant, its owners, officers, employees, agents, contractors, affiliates, and insurers (the "Released Parties") are not responsible or liable for any injury, illness, loss, theft, damage, or harm of any kind — whether to person or property — that occurs inside the Restaurant, in any adjacent area, on the sidewalk, in any parking area, or otherwise off-premises, before, during, or after your visit.
This includes, without limitation, slips, trips, falls, altercations between guests, criminal acts of third parties, loss of personal belongings, vehicle damage or theft, and any incident involving alcohol consumption or food allergies.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THE TOTAL AGGREGATE LIABILITY OF THE RELEASED PARTIES TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO YOUR VISIT OR ORDER SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE RESTAURANT FOR THE ORDER OR VISIT GIVING RISE TO THE CLAIM. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or as otherwise required by New York law.
We reserve the right to refuse service or remove any guest who behaves in a manner that is disruptive, unsafe, harassing, discriminatory, or otherwise inappropriate. Guests are responsible for their own personal property. We strongly recommend that you keep your belongings with you at all times.
All prices are listed in U.S. dollars and are subject to applicable taxes and gratuity. We reserve the right to change menu items and pricing at any time. Refunds and re-makes are handled at the sole discretion of management. Disputes regarding charges should be raised with management before leaving the premises whenever possible.
The Restaurant is a public establishment. Photography and video may occur on the premises for promotional or security purposes. By entering, you consent to incidental capture of your image and its use in our marketing materials, unless you notify management in writing in advance.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO A JURY TRIAL.
You and the Restaurant agree that any dispute, claim, or controversy arising out of or relating to these Terms, your visit to the Restaurant, or any food or beverage you consumed (a "Dispute") shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be held in New York County, New York, before a single arbitrator, and judgment on the award may be entered in any court of competent jurisdiction.
YOU AND THE RESTAURANT EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. All Disputes must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
30-Day Right to Opt Out. You may opt out of this arbitration agreement by sending written notice to TeamworkOn3 Bistro, 2021 Lexington Ave, New York, NY, within thirty (30) days of your first visit or order. The notice must include your full name, address, and a clear statement that you wish to opt out of arbitration.
Notwithstanding the foregoing, either party may bring an individual action in small-claims court for Disputes within that court's jurisdiction. This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.). If any portion of this Section is found unenforceable, the remainder shall remain in full force and effect.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Subject to the arbitration provision above, any action not subject to arbitration shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.
If any provision of these Terms is held invalid or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full force and effect.
We may update these Terms at any time. The version posted on our website at the time of your visit or order governs that visit or order. Continued patronage after changes constitutes acceptance of the updated Terms.
